General terms and conditions Restaurant
1. Basic
These General Terms and Conditions (GTC) govern the legal relationship between the guest and Romagnolo AG as operator of the restaurant BOCUCI Bottega & Cucina, hereinafter referred to as the restaurant. For the sake of simplicity, these GTC - regardless of the service - always refer to the contract. The terms and conditions of the restaurant valid at the time of the conclusion of the contract shall apply exclusively. Should individual provisions of these GTC be or become invalid or void, this shall not affect the validity of the contract and the remaining GTC provisions. In all other respects, the statutory provisions shall apply.
2. Jurisdiction / Applicable Law
Zurich shall be the place of jurisdiction for any disputes arising from this contract. Swiss law is exclusively applicable to all contractual, reservation, any supplementary agreements and general conditions. The place of performance and payment is the registered office of the Restaurant.
3. Scope of services
The scope of services of the contract is determined according to the individual reservation made by the guest. The guest has - other contractual agreements reserved - no right to a specific table. The restaurant may require a credit card guarantee in lieu of a deposit. In case of no-show a one-time fee of CHF 70 / person will be charged to the credit card indicated at the time of reservation.
4. Prices / payment obligation
The prices quoted by the restaurant are in Swiss francs (CHF) and include the statutory value added tax. The guest is obliged to pay the agreed or applicable prices of the restaurant for the services used by him. This also applies to services and expenses of the restaurant to third parties arranged by the guest, his companions and visitors. Any increase in statutory charges after the conclusion of the contract shall be borne by the guest. Prices in foreign currencies are indicative and will be charged at the current exchange rate. All published prices may be adjusted at any time without notice to the guest. The valid prices are those confirmed by the restaurant.
5. Events
General provisions regarding the services of banquets and events are regulated in the GTC's Banquet.
6. Food and drinks
All food and beverages are to be purchased exclusively from the restaurant. In special cases, a different written agreement can be made on this. In such a case, the restaurant is entitled to charge a service fee or a corkage fee (CHF 35 / bottle).
7. Insurance
The insurance for materials brought in is in any case the responsibility of the guest.
8. Liability and contract law
a) Restaurant
The Restaurant excludes liability within the limits of the law for slight and medium negligence and is liable only for damage caused intentionally or by gross negligence. The restaurant is liable for the guests' belongings brought to the restaurant in accordance with the law. The restaurant is not liable for slight and medium negligence. The Restaurant declines any liability for theft and damage of the material brought by third parties. The Restaurant shall not be liable under any legal title for services which it has merely arranged for the Guest (see also clause 13).
b) Guest
The guest is liable to the restaurant for all damages and losses caused by him, companions or his assistants or event participants, without the restaurant having to prove fault on the part of the guest. If a third party has made the booking for the actual guest, the third party is liable to the restaurant as joint and several debtor for all obligations arising from the contract. The guest is liable for arranged services and expenses of the restaurant to third parties.
9. Illness of the guest
If a guest becomes ill during his or her stay at the restaurant, the restaurant will notify a physician at the guest's request. If the Guest is no longer capable of acting and the Restaurant has knowledge of the illness, it may notify a physician even without the Guest's request. In any case, medical care is provided at the expense of the guest.
10. Animal keeping
Animals may be brought only with the prior consent of the restaurant. The guest who brings an animal to the restaurant is obliged to keep or supervise this animal properly during his stay. The guest must have appropriate pet owner insurance for their pet. Proof of appropriate insurance must be presented when requested by the restaurant.
11. Further provisions
If the guest requests services that are not provided by the restaurant itself, the restaurant acts only as an intermediary. Advertisements in the media (such as newspapers, radio, television, Internet) with reference to events in the restaurant, with or without the use of the unchanged company logo, require the prior written consent of the restaurant.
GTC Banquet / Events
1. Subject matter of contract / scope
The contract for the rental of tables and areas as well as other deliveries and services is concluded with the written confirmation by the restaurant or, in the case of Internet bookings, with the booking confirmation of the guest. A reservation made on the day of the event itself is binding at the moment of acceptance by the restaurant. Changes to the contract will only become binding for the restaurant through a (written) reconfirmation. Unilateral changes or additions to the contract by the guest are invalid.
2. Scope of services
The scope of services of the contract is determined according to the individual reservation made by the guest. The guest has - other contractual agreements reserved - no claim to a specific table / room
3. Food and drinks
All food and beverages are to be purchased exclusively from the restaurant. In special cases, a different written agreement can be made on this. In such a case, the restaurant is entitled to charge a service fee or a corkage fee (CHF 35 / bottle).
4. Number of participants
The definitive number of participants must be communicated in writing at least 7 days before the event. For groups up to 20 people 3 days in advance. This number of persons serves as the basis for billing. If no service has been defined for banquet events, a base amount of CHF 60/person is assumed. For no-show guests, the full menu cost will be charged.

The guest is obliged to pay the agreed or applicable prices of the restaurant for the services used by him. This also applies to services and expenses of the restaurant to third parties arranged by the guest, his companions and visitors. Any increase in statutory charges after the conclusion of the contract shall be borne by the guest. Prices in foreign currencies are indicative and will be charged at the current exchange rate. All published prices may be adjusted at any time without notice to the guest. The valid prices are those confirmed by the restaurant. Depending on the agreement or from a reservation amount of CHF 2000, the restaurant may require a deposit of 50% of the total booking amount. The down payment is to be understood as a partial payment on the agreed fee. The restaurant may require a credit card guarantee in lieu of a deposit. An advance payment is to be transferred within 10 days after receipt of the reservation confirmation. If the reservation is made at short notice, the restaurant requires a credit card guarantee for the entire booking amount. If the deposit or the credit card guarantee is not paid on time, the Restaurant may immediately terminate the contract (without a reminder), or withdraw from the service promises made and demand the cancellation fees mentioned in paragraph 7. The Restaurant has the right to invoice or interim invoice its services at any time. The final invoice shall include the agreed price plus any additional amounts incurred due to separate services provided by the Restaurant for the Guest and/or the persons accompanying him/her. Payment can be made in cash in Swiss francs or with an accepted credit card. Payment on account is possible after prior written confirmation. Delivery of the invoice by e-mail, payable within 20 days net.
6. Minimum consumption
Romagnolo AG charges a minimum consumption fee of CHF 6,500.00 (pure food & beverage sales) for exclusive events in the entire BOCUCI restaurant. If the minimum turnover is not reached, the difference will be charged as hall rent.
7. Cancellation provisions
Withdrawal of the guest from the contract concluded with the restaurant requires the written consent of the restaurant. If this is not done, the agreed price from the contract must be paid even if the guest does not use contractual services. Decisive for the calculation of the cancellation fee to be paid is the arrival of the guest's written cancellation at the restaurant. This applies to both letters and e-mail messages. If the guest withdraws from the contract or if changes or cancellations of certain reserved services are made, the restaurant may charge the following cancellation fees.
7.1. Cancellation fees
for events If an event cannot be held for reasons that are not attributable to the Restaurant and for which the Restaurant is not responsible, the Restaurant retains the right to (partial) payment of the agreed service in accordance with the order confirmation, taking into account receipt of the written cancellation as follows:
- Cancellation of the event 0 - 15 days before the date: 100% according to the order confirmation
- Cancellation of the event 16 - 30 days before the date: 50% according to the order confirmation
- Cancellation of the event 31 - 60 days before the date: 30% according to the order confirmation
In the event of the implementation of an equivalent (scope of services) event by a third party during the agreed period, the guest will only incur a turnover fee of 10 - 30% (depending on the timeliness of the cancellation).
8. Regulations FOPH
If the FOPH Switzerland (Federal Office of Public Health) decides to cancel group reservations, the costs will not be refunded and the reservation will be reduced by max. 1 year contractually postponed. Should this nevertheless be cancelled by the organizer, organization fees of CHF 200 will be charged.
9. Exclusion
If Restaurant BOCUCI has reasonable grounds to believe that the event will jeopardize the smooth operation of the business, the safety or the reputation of the establishment, it shall be entitled to terminate the reservation agreement at any time without compensation.
10. Extensions
If the reserved event duration is expected to exceed the legal closing hour (police hour), the guest must contact the restaurant at least 5 days before the start of the event so that the necessary permits can be obtained. The cost of the permits will be charged to the guest. The restaurant cannot guarantee the issuance of permits. The restaurant has the right to expel the event participants from the premises after the renewal permit expires.
11. Insurance
The insurance for materials brought in is in any case the responsibility of the guest. The restaurant may request proof of insurance even before confirming the reservation.

16. Validity
These GTC's are valid from 1 January 2022.
17. Place of jurisdiction
The place of jurisdiction is Zurich. Swiss law is exclusively applicable.
